1. OUR SERVICES
The Services are not intended for use in jurisdictions or countries where such use would be unlawful or subject us to registration requirements. Users accessing the Services from other locations do so at their own risk. The Services consist solely of simulated trading evaluations conducted in a virtual environment using fictitious funds. No real financial instruments are traded. The Services are not designed to comply with industry-specific regulations such as HIPAA, FISMA, GLBA, MiFID II, SEC regulations, or other financial regulatory frameworks applicable to brokerage or investment firms. You may not use our Services if such laws apply to your activities. Certain jurisdictions may be restricted in accordance with applicable laws.
2. INTELLECTUAL PROPERTY RIGHTS
Our Intellectual Property We own or license all intellectual property in the Services, including source code, databases, software, website design, text, audio, video, graphics, and trademarks (“Content” and “Marks”). They are protected by copyright, trademark, and other intellectual property laws. You may use the Services and Content only for personal, non-commercial, or internal business purposes. Your Use of Our Services We grant you a non-exclusive, non-transferable, revocable license to access and use the Services and to download or print Content for personal use only. No Content or Marks may be copied, sold, reproduced, or exploited commercially without prior written consent. Requests for permission should be sent to support@funderblu.com. Your Submissions By sending us feedback, ideas, or other information (“Submissions”), you assign all intellectual property rights to us, allowing unrestricted use without compensation. You represent that: • Your Submissions are original or you have rights to submit them. • They are not illegal, defamatory, or misleading. You are responsible for any losses arising from your breach of these conditions.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that: 1. All information you provide is true and current. 2. You have the legal capacity to agree to these Terms. 3. You are not a minor. 4. You will not use automated tools or bots. 5. You will not use the Services for illegal purposes. We may suspend or terminate your account if any information provided is false or misleading.
4. USER REGISTRATION
You may be required to register to use the Services. You agree to keep your password confidential and accept responsibility for all account activity. We reserve the right to change or remove usernames we consider inappropriate.
5. PROHIBITED ACTIVITIES
You agree not to • Collect data from the Services without authorization. • Mislead, defraud, or harm users. • Interfere with security features. • Harass or abuse others. • Upload viruses or malicious code. • Engage in unauthorized linking or framing. • Reverse-engineer the software. • Use bots, scripts, or automated systems. • Use the Services for commercial gain without approval.
6. USER GENERATED CONTRIBUTIONS
If the Services allow user content (“Contributions”), you confirm that: • You own or have rights to your Contributions. • They do not violate third-party rights or laws. • They are not defamatory, obscene, or harassing. • We may remove or restrict any Contributions violating these Terms.
7. CONTRIBUTION LICENSE
You retain ownership of your Contributions but grant us a license to use, reproduce, and display them as necessary for operation of the Services. Feedback or suggestions you provide may be used freely without compensation.
8. THIRD-PARTY WEBSITES AND CONTENT
The Services may contain links to third-party websites or content. We are not responsible for their accuracy, legality, or safety. Accessing such content is at your own risk.
9. SERVICES MANAGEMENT
We reserve the right to: • Monitor the Services for violations. • Remove or restrict content. • Report unlawful activity. • Manage the Services for performance and safety.
10. TERM AND TERMINATION
These Terms remain in effect while you use the Services. We may suspend or terminate your account at any time for any reason, without notice.
11. MODIFICATIONS AND INTERRUPTIONS
We may modify or discontinue the Services at any time without notice. We are not liable for any downtime or loss caused by such interruptions.
12. GOVERNING LAW
These Terms are governed by the laws of Hong Kong. You agree to the exclusive jurisdiction of the courts of Hong Kong for all disputes.
13. DISPUTE RESOLUTION
All disputes shall be referred to binding arbitration under the International Commercial Arbitration Court (European Arbitration Chamber, Brussels). Seat of arbitration: Hong Kong Language: English Governing law: Hong Kong Exceptions: disputes regarding intellectual property rights, privacy violations, or injunctive relief may be brought before Hong Kong courts.
14. CORRECTIONS
We may correct or update any errors, omissions, or inaccuracies in the Services at any time without notice.
15. DISCLAIMER
The Services are provided “as is” and “as available.” The Services are strictly for evaluation and educational purposes within a simulated trading environment. Nothing on the Site constitutes financial advice, investment advice, trading advice, or a recommendation to buy or sell any financial instrument. We disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose. We are not liable for: • Errors or inaccuracies • Unauthorized access • Service interruptions • Viruses or malware • Losses arising from third-party products or services • Hypothetical or simulated performance differences Simulated trading results have inherent limitations and do not reflect actual trading performance.
16. LIMITATIONS OF LIABILITY
We shall not be liable for any direct, indirect, incidental, or consequential damages (including loss of rewards, data, or goodwill) arising from your use of the Services.
17. INDEMNIFICATION
You agree to indemnify and hold us harmless against any claims, losses, or damages arising from your use of the Services, breach of these Terms, or violation of any third-party rights.
18. USER DATA
We may maintain data you transmit for operational purposes. We are not liable for loss or corruption of such data.
19. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
You consent to receive electronic communications and agree that electronic contracts and signatures have the same legal effect as written ones.
20. CALIFORNIA USERS AND RESIDENTS
Unresolved complaints may be directed to the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, USA.
21. REFUND POLICY
Purchases of evaluation programs grant immediate access to digital Services. By completing a purchase, you acknowledge and agree that: • You are purchasing access to a digital evaluation service. • Access to the evaluation is delivered immediately upon payment confirmation. • Due to the digital and instantly accessible nature of the Services, all purchases are final and non-refundable once access has been granted. Refunds may be considered only under the following limited circumstances: • Duplicate payments • Technical errors preventing account creation • Billing errors attributable to us Refund requests must be submitted in writing to support@funderblu.com within 7 calendar days of purchase. We reserve the right to deny refund requests where: • The evaluation account has been accessed or traded • Trading rules have been breached • A chargeback has been initiated • Fraudulent activity is suspected Initiating a chargeback without contacting us first may result in permanent account suspension.
22. MISCELLANEOUS
These Terms and any related policies constitute the entire agreement between you and us. If any provision is deemed unlawful, it shall not affect the validity of the remaining terms. We may assign our rights and obligations to others at any time.
